These Service Terms govern paid use of the Optimize Pilot product (app.optimizepilot.com, the MCP server, the Chrome extension, and the WordPress plugin). If you or your employer are an Optimize Pilot customer, these terms apply between us.
Subscriptions are monthly or annual at the prices listed on the pricing page or your signed order form. Annual subscriptions save approximately 17% vs monthly and include a 30-day money-back guarantee for first-time customers.
Monthly plans cancel at the end of the current billing period. Annual plans cancel with pro-rata refund for unused time. Enterprise agreements follow the terms of the signed order form.
You own your data. We host and process it as your data processor. You may export at any time — CSV, JSON, or via API. On account closure we provide a full export and purge within 90 days unless you request sooner. No data is sold or used for third-party advertising.
You may use Optimize Pilot for lawful growth optimization work on sites you own or are authorized to operate. You may not use the product to interfere with third-party services beyond publicly-available content, crawl behind authentication walls you are not authorized for, or build competing services by scraping Optimize Pilot. Any misuse is grounds for account suspension.
Autonomy is opt-in per-user, per-site, per-tool. Destructive operations (stop_experiment, deploy_winner) require explicit confirmation. Every autonomous action produces a signed attestation token recording what the agent read and the proof URL of the change. You remain responsible for the outcomes of actions you authorized.
99.95% uptime SLA on Growth and Performance tiers; 99.99% on Enterprise. Credits issued per the SLA schedule. Maintenance windows announced in advance on the status page. Scheduled maintenance does not count against SLA.
Encryption in transit (TLS 1.3) and at rest. Role-based access. Magic-link authentication. GDPR and CCPA-aligned data handling. DPA available on request for any paid tier.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages. Our total aggregate liability is limited to the fees paid in the 12 months preceding the claim. Gross negligence and willful misconduct are excluded from this limit.
Either party may terminate for material breach with 30 days\' written notice and opportunity to cure. Customer may terminate for convenience per the cancellation terms above. Upon termination we export + purge data per Section 2.
These Terms are governed by Texas law. Jurisdiction in Travis County, Texas. Enterprise customers may negotiate governing law and venue in the signed order form.
